OUR WEBSITE POLICY

Universal Protection Service of Canada Corporation is committed to maintaining ‎the security, confidentiality, and privacy of personal information. This Website Privacy ‎Policy (“Policy”) documents our ongoing commitment and has been developed in ‎compliance with applicable privacy legislation and is subject to revision on an ongoing basis.

Scope of Policy

This Policy applies to Allied Universal and any affiliates from ‎time to time, including G4S Retail Solutions (Canada) Inc. and MSA Security Canada Limited (collectively, “Allied Universal” or “we” or “us”) in ‎respect of employee data and information that are subject to Canadian federal and provincial privacy ‎legislation.‎ This Policy may be updated from time to time to include other entities depending on business and operational needs in Canada.

This ‎Policy also does not apply to the collection, use or disclosure of the following ‎information by Allied Universal:‎

  • business contact information, as defined in applicable privacy legislation;‎ or ‎

  • publicly available information recognized under applicable privacy legislation.

Key Elements of this Policy

1. Accountability

Allied Universal is responsible for personal information under its ‎control. This extends to personal information collected during the course of conducting business, including employee personal information, the latter being governed by a separate Employee Privacy Policy. We have designated a Privacy Officer who is responsible for Allied Universal’s compliance with applicable privacy legislation and this Policy. Our Privacy Officer’s contact information is set out in section 14 below.

2. Information Collected

We may collect some or all of the following information from you: ‎ 

  • your name and job title; 

  • your email address and phone number; 

  • your address; and 

  • other specifics, depending on the nature of the query.

3. Purposes

You may contact our Privacy Officer who can answer ‎questions about the collection of personal information pursuant to this Policy – please see section 14 for contact information.‎ 

Upon or before collecting personal information, Allied Universal will state the ‎purpose of collection, unless collection is authorized by applicable law without notice or consent. You may contact our Privacy Officer who can answer ‎questions about the collection of personal information pursuant to this Policy.  

We collect, use and disclose personal information for purposes authorized ‎or required by applicable privacy legislation or other law and for the ‎following purposes:‎ 

  • to operate, maintain, and improve our website and address questions/queries from members of the public; 

  • to manage and develop our business and operations; 

  • to provide information to anyone working with or for Allied Universal ‎as needed for the provision of our services; 

  • to maintain accurate customer records; to collect debts owed to use; 

  • to issue invoices, process payments and collect debts owed to Allied Universal; ‎ 

  • to engage in business transactions, including, potentially, the sale, transfer, securitization, ‎financing or other disposition of assets or liabilities of Allied Universal; and 

  • to distribute to third parties including financial institutions, payment processors, lawyers, ‎financial ‎institutions and regulatory bodies for any of the above purposes‎. 

 

We may also, with your consent, use your personal information for the following additional ‎purposes: 

  • To offer you additional or alternative services or products (in connection with this, we may add your contact information to distribution lists, ‎which we prepare and use for this purpose in accordance with Canadian ‎anti-spam legislation);‎ 

  • To provide you with newsletters, bulletins, and information about upcoming ‎events or promotions and other general information about our industry and about Allied Universal, in accordance with Canadian anti-spam legislation;‎ and 

  • To contact you for survey and quality assurance purposes.‎ 

If you do not want us to use your personal information for these additional ‎purposes you may opt out at any time by providing written notice to the Allied Universal Privacy Officer (or by unsubscribing to electronic ‎newsletters, bulletins, etc.) at privacy@ausecurity.ca. You will not be refused services merely ‎because you asked Allied Universal to stop using your information in ‎these ways.‎ 

Before using or disclosing personal information for a purpose not previously ‎identified, we will identify the new purpose and obtain your consent unless ‎the use or disclosure is authorized or required by law.

We will obtain your consent to collect, use or disclose personal information ‎except where we are authorized or required by law to do so without ‎consent. For example, we may collect, use or disclose personal information ‎without your knowledge or consent where:‎ 

  • The personal information is publicly available from a prescribed source, such ‎as a telephone directory or an electronic publication;‎ 

  • Allied Universal is collecting or paying a debt;‎ or 

  • It is reasonable to expect that obtaining consent would compromise an ‎investigation or proceeding. 

 

Where applicable, your consent can be expressed or implied and given directly or through an authorized ‎representative such as a lawyer, agent or broker.‎ 

Consent may be provided orally, in writing, electronically, or, where applicable, through inaction (such as if you were to not respond that you do not wish for your personal ‎information to be collected/used/disclosed for optional purposes after ‎reasonable notice of such potential activity and purposes therefor) or otherwise. By providing personal information ‎to us, you agree that we may collect, use and disclose such personal ‎information as set out in this Privacy Policy and as otherwise permitted or ‎required by law.‎ 

You may withdraw consent at any time, subject to legal or contractual ‎restrictions, provided that reasonable notice of withdrawal of consent is ‎given to Allied Universal. On receipt of notice of withdrawal of ‎consent, we will honor your request and inform you of the likely consequences of the withdrawal of ‎consent, which may include our inability to provide services for which that ‎information is necessary.‎ Withdrawing your consent does not affect the legality of any use or communication of personal information made prior to the withdrawal. 

5. Limits on Collection of Personal Information


We will limit ‎collection of personal information to that which is reasonable and necessary ‎to provide our services and to fulfil the ‎purpose(s) as to which you gave consent. Allied Universal also collects ‎personal information as authorized or required by law.‎ 

6. Limits for Using, Disclosing and Retaining Personal Information

Your personal information will only be used or disclosed for the purposes ‎set out above and as authorized by law.‎ 

We will destroy, erase or anonymize documents or other records ‎containing personal information as soon as the original purpose of collection has been fulfilled or is no longer being served by retention of the ‎information and retention is no longer necessary for legal or business ‎purposes.‎ 

We will take due care when destroying personal information so as to ‎prevent unauthorized access to the information.‎ 

7. Accuracy

 

We will make reasonable efforts to ensure that personal information we ‎collect, use or disclose is accurate and complete. In some cases, we rely on ‎you to ensure that certain information, such as your address or telephone ‎number, is current, complete and accurate.‎ 

If you demonstrate the inaccuracy or incompleteness of personal ‎information, we will amend the information as required. If appropriate, we ‎will send the amended information to third parties to whom the information ‎has been disclosed.‎ 

8. Safeguarding Personal Information

We recognize our obligations to protect the ‎confidential information of our customers. We recognize as well our legal ‎obligations to protect the personal information we have gathered about our ‎customers and about other individuals during the course of our work. 

We have therefore made reasonable physical, technological and organizational‎ arrangements designed to secure against the unauthorized ‎access, collection, use, disclosure, copying, modification, disposal or ‎destruction of personal information. 

Please note that confidentiality and security are not assured when ‎information is transmitted through email or other electronic communication. ‎We will not be responsible for any loss or damage as a result of a breach of ‎security and/or confidentiality when you transmit information to us by email ‎or other electronic communication or when we transmit such information by ‎such means at your request. 

9. Disclosures and Transfers of Personal Information; Cross-Border Transfers

Allied Universal may disclose or transfer personal information as follows: 

  • Affiliates: Allied Universal is affiliated with other Allied Universal entities. We make use of those other ‎entities’ global administrative resources for processing or storing your personal information.  

  • Service Providers:  Allied Universal may also retain agents, subcontractors or service providers from time to time in relation to our business or the products or services that we provide, including data processing/storage providers, legal services providers, website service providers, marketing service providers, IT support service providers, providers and managers of the security equipment we need to provide our security services, delivery service providers, email administrators, payment processors and customer service providers, and other suppliers of products and services. If we require a service provider to deal with your personal ‎information, we will take reasonable steps to ‎ensure that the service provider adheres to reasonable privacy ‎procedures and will keep your personal information ‎reasonably secure. ‎ 

  • Business Transactions:  If Allied Universal is or may be acquired by or merged or amalgamated with another company, if any of our assets are ‎transferred to another company, if someone invests in us, if we undergo a corporate re-organization, if we sell of ‎all or a ‎substantial portion of our assets, or as part of a bankruptcy proceeding, we may, in accordance with applicable law, ‎transfer the information we have collected from you to the other company and we may share your information ‎in the course of the transaction.‎ 

Any of the entities that may receive or process personal information as described above may be located in jurisdictions outside ‎of your province or territory of residence, including outside of Canada, and these activities may therefore ‎involve your personal information being transferred, stored or accessed in those jurisdictions. 

You acknowledge that governments, courts or law enforcement or regulatory agencies in those jurisdictions may be able ‎to ‎obtain disclosure of that personal information through the applicable jurisdiction’s laws. 

10. Openness


Allied Universal is open about the policies and procedures it uses ‎to protect your personal information. Information about these policies and ‎procedures will be made available on our website or by any appropriate means. However, to ensure the integrity of our ‎security procedures and business methods, we do not disclose sensitive ‎information about our policies and procedures.

11. Providing Access

You have a right to access your personal information held by Allied Universal.   

Upon written request to the contact information included below and authentication of your identity, we will provide you with ‎your personal information under our control, information about the ways in ‎which that information is being used and a description of the individuals and ‎organizations to whom that information has been disclosed. 

We may need to request specific information from you to help us confirm your identity and ‎ensure your ‎right to access the information (or to exercise any of your other rights). This is ‎another appropriate ‎security measure to ensure that personal information is not disclosed to any ‎person who has no right to ‎receive it.‎ 

Access to your information will generally be free of charge. We may however charge a reasonable fee for the transcription, reproduction or transmission of information in response to ‎an access request and will provide an estimate of any such fee upon ‎receiving an access-to-information request. We may require a deposit for all ‎or part of the fee. 

We will make the information available within 30 days or provide written ‎notice where additional time is required to fulfill the request. 

In some situations, we may not be able to provide access to certain ‎personal information. This may be the case where, for example, disclosure ‎would reveal personal information about another individual, the personal ‎information is protected by solicitor/client privilege, the information was ‎collected for the purposes of an investigation, disclosure of the information ‎would reveal confidential commercial information that, if disclosed, could ‎harm the competitive position of Allied Universal. Allied Universal may also be prevented by ‎law from providing access to certain personal information. 

Where an access request is refused, we will notify you in writing, document ‎the reasons for refusal and outline further steps which are available to you. 

12. Changes

We may review and change our Privacy Policy from time to time. You will be notified of any such changes via our website or any other appropriate means.  Where required by applicable law, we may need to ask you to confirm your consent to the ‎processing ‎of your personal information. Otherwise, your continued access to or use of our services constitutes ‎your acknowledgment and acceptance of those ‎changes.‎ 

13. Website; Online Collection and Use of Information

Our website uses cookies, as described in Allied Universal’s Cookie Policy. 
‎Our website may also contain links to other sites and ‎advertisements; however, our Privacy Policy only applies to information ‎collected by our website. We are not responsible for the privacy practices ‎and policies of third parties. 

14. Compliance

Allied Universal will, on request, provide information regarding its ‎complaint procedures.‎
